– BPD officers were working a late night detail at a construction site near the intersection of Warren and Washington Streets in Boston’s Roxbury neighborhood when client was alleged to have crossed through a detour sign and stop near the construction site. One officer approached client’s car and began to question him. After observing an odor of alcohol and glassy eyes, he asked client to step out of car to perform FSTs. Client failed both tests and was arrested. At trial, Attorney Seed was able to show that client was not impaired by alcohol consumption and that the area he drove through was confusing and not fully blocked off. He further convinced the judge that there was no evidence that Client was speeding or operating negligently in any manner. Client found Not Guilty on all counts.
