Brighton District Court
– Client was involved in a car accident on Comm. Ave in Allston at noon and left the scene. Two hours later, she was found parked on the side of Academy Hill Road sleeping in her car.
Police had to break into the car to wake client and there were numerous empty and unopened liquor bottles in the vehicle. At the clerk magistrate’s hearing, Attorney Seed was able to show that
the client could not be properly identified as the person involved in the earlier accident. Furthermore, he was able to show that there was insufficient evidence as to whether or not the car was on and running when the police arrived.
Because there was no evidence of operation, the charges did not issue against the client and the case was dismissed prior to arraignment.
