Commonwealth v. A.O. – OUI Drugs / Negligent Operation

Client observed driving around Route 1 rotary with a headlight out. Client is stopped by Newburyport Police and asked for license and registration, which Client provides.
Officer notes red, glassy eyes and an odor of fresh marijuana coming from the vehicle. He asked Client if Client had smoked marijuana, to which Client replied “20 minutes ago”. Client asked to step from car and placed under arrest. Attorney Seed filed and argued a motion to suppress the illegal arrest of his Client. After testimony from the officer and arguments, a Judge agreed with Attorney Seed and suppressed the evidence. Case dismissed.
