Commonwealth v. E.M. – OUI 2nd

Outcome: Not Guilty

New Bedford District Court

Client stopped by Dartmouth Police at 5:00 AM one morning for driving infractions. He appears lethargic and shows signs of alcohol consumption. He is asked to step from his car and is put through several FSTs. He is then placed under arrest for OUI 2nd offense. At trial, Attorney Seed crosses the officer on his training and experience and raises doubt as to how the client performed on the tests. He further offers into evidence the booking video, showing how well the Client was able to cooperate with the police and have no difficulty balancing. Client found Not Guilty.
