Commonwealth v. J.G. – OUI, Failure to Stop for Police

– Client allegedly drives past a police officer on traffic patrol going 60 MPH and refuses to stop after officer activates his lights and sirens. Officer follows client all the way to his home, where client parks in the driveway. Seven officers arrive on scene and order client out of car at gunpoint. He is described to have an odor of alcohol, glassy eyes and slurred speech. Officers do not offer client any field sobriety tests. At trial, Attorney Seed was able to convince the trier of fact that there was insufficient evidence to prove his client was OUI beyond a reasonable doubt. Client was found Not Guilty and his license to operate was immediately restored by the judge.
