Commonwealth v. J.M. – OUI
– New Bedford Police
– New Bedford District Court
– Client is outside his car at 5am one morning when he encounters a Bristol County Sheriff’s Officer. The Officer feels that the client is acting erratically and gets him out of the car and places him in handcuffs. Client is held in handcuffs for 20 minutes until NBPD arrives on scene. Client placed under arrest for OUI by police. In court, Attorney Seed files a motion to suppress the stop and illegal seizure of his client. Arguing that the Sheriff’s Officer acted outside his authority and illegally seized client, Attorney Seed is able to convince the judge that his client was illegally stopped and arrested. The motion to suppress is allowed and the case dismissed. Client’s right to operate a motor vehicle is immediately reinstated.
