Commonwealth v. W.E. – OUI 2nd
Dedham District Court
Mass State Police
– Client stopped by MSP on Rt. 95 for speeding and marked lanes violations. Client has strong odor of alcohol on him and glassy eyes. Client fails all three field sobriety tests given to him and refuses breath test at barracks by stating he “didn’t want to give them any more ammo.”
After lengthy litigation and extensive motion filing, the judge dismisses the case on date of trial. Furthermore, the judge allowed Attorney Seed’s motion to immediately reinstate his client’s driver’s license. It had previously been suspended for three years for a second offense breath test refusal.
