Commonwealth v. D.B. – OUI Drugs

– Client involved in motor vehicle accident after she swerved to avoid a pedestrian and struck a parked car. When police arrived they formed the opinion that client was OUI. Client had a prescription for Vicodin on her person which was seized by police. She also admitted to consuming two beers. She was not placed under arrest nor subjected to any FSTs. On the day of trial, Attorney Seed was able to convince both the ADA and Judge that the Commonwealth could not meet its burden that his client was OUI Drugs based on the facts. Both agreed and the case was dismissed. A motion to restore her driver’s license was immediately filed and allowed by the Judge.
