Client observed by State Police driving down Route 99 in Everett late one night with two flat tires. Client is stopped by the Trooper and immediately gets out of his vehicle. He explains that his tire is flat and he is just trying to get home. Trooper observes several indicators of impairment and client admits to drinking that evening. Client fails two FSTs and is placed under arrest. Client also registers a .16 Breath Test. At trial, Attorney Seed is able to exclude the breath test and effectively cross examine the trooper with respect to the other tests performed. Client is found Not Guilty.
